See if your company name is available for use. In order for you to form a business entity in Texas you must decide on a name for your company. However, there are thousands of businesses in Texas and no two companies may have the same, or even similar, names. Therefore, you should first determine if the name you want for your company is available for your use. We at the Bloodworth Law Firm, as a part of our Business Formation services check on name availability for you. If you want to do this work yourself you must contact the Texas Secretary of State Corporations Section at (512) 463-5555, dial 7-1-1 for relay services, or e-mail your name inquiry to Corporations Section. A final determination cannot be made until the document is received and processed by the Secretary of State. Do not make financial expenditures or execute documents based on a preliminary clearance. Also note that the preclearance of a name or the issuance of a certificate of formation under a name does not authorize the use of a name in violation of another person’s rights to the name.
